notex Terms of Service
Effective October 26, 2026. These terms are the agreement between you and Jacob Wadzinske, who operates notex (“we”, “us”). They cover the notex app for Android and iOS, which turns notes (a PDF, scanned pages or photos) into LaTeX, and the service behind it (together, “notex”). By signing in to notex and tapping Agree, you agree to them. If you don’t agree, don’t use notex.
Please read sections 8, 13, 14 and 15 and the end of section 9 in particular. They say that AI results can be wrong, that notex comes without warranties, how far we are liable, how disputes are handled, and when you answer for claims that your content causes.
These terms are offered in English and in French (Version française). The app and its support are in English only.
1. Who we are
notex is operated by Jacob Wadzinske, an individual in the United States, not by a company. Write to support@notex.us with any question about notex or these terms. If notex moves to a company, section 19 explains what changes.
2. Who can use notex
- You must be 18 or older. notex is not for anyone under 18. By using notex, you confirm that you are 18 or older.
- Where Google Play or Apple provide an age range, the app asks them for it. If they say you are under 18, the app blocks notex on that device and signs you out. The age range stays on the device and is never sent to us. The privacy policy (section 7) explains how.
- If we learn in another way, such as from a report, that an account belongs to someone under 18, we delete the account and its data.
- You must not be barred from using notex by US sanctions or export laws.
- We offer notex in the United States and Canada.
3. Your account
- You sign in with Google (on Android and iOS) or Apple (on iOS). notex has no passwords. Your notex account is tied to the Google or Apple account you sign in with.
- Keep your Google or Apple account and your devices secure. You are responsible for what you, or anyone you let use your device or your Google or Apple account, do in your notex account. If you think someone else has used your notex account, write to us at once.
- You can delete your account at any time, in the app (Account › Delete account) or by email. While a conversion is queued or running, the app cannot delete it: try again once the conversion has finished. Delete your notex account explains both ways and what is kept afterwards. Uninstalling the app does not delete your account.
- Deleting your account deletes your projects and forfeits any remaining credits.
4. Credits and limits
- Each conversion uses one credit. If a conversion fails, its credit is refunded. Converting the same project again uses a new credit.
- A new account gets free starter credits. The support page says how many, and the Account tab shows your balance.
- Starter credits are given once per Google or Apple account. If you delete your account and sign up again with the same Google or Apple account, it starts with 0 credits. notex decides this automatically; write to us to have a person review it.
- Credits have no cash value. You can’t sell or transfer them or exchange them for money. They end when your account is deleted or closed.
- We may change how many starter credits new accounts get, or stop giving them. That does not take away credits already in your account. We may correct a balance that is wrong because of an error, and remove credits obtained by breaking these terms.
- To keep notex working for everyone, it has limits: for example on conversions and uploads per day, on the size and page count of an upload, and on the number of projects. The support page describes the current limits. We may change them.
5. Price
notex is free. You pay nothing for the app, your account or your credits, and credits can’t be bought. If we ever sell credits or anything else, we will first add the terms for it to these terms, as section 16 describes.
6. Third-party services
- You sign in through Google or Apple, and you get the app from Google Play or the App Store. Their own terms apply to those services, and Google and Apple are not responsible for notex. Section 20 has more about the App Store.
- notex runs on other companies’ services. It converts your pages with Anthropic’s Claude model, running on Amazon Bedrock (AWS), and it stores your data with AWS. The privacy policy names every provider that processes your data for us.
- We don’t control these companies or their services. Section 14 limits our liability for their outages and for changes they make that affect notex. This does not reduce our responsibility for your personal information under privacy law.
- You need a compatible device and an internet connection to use notex. Your mobile carrier’s charges apply.
7. Your content
“Your content” means the PDFs, photos and scanned pages you upload, what you type (project names, notation notes and problem reports), and the LaTeX and PDF that notex makes from your pages.
- You keep every right you have in your content. As between you and us, the LaTeX and PDF made from your pages are yours. You may use, copy and change any part of them that comes from notex, such as its LaTeX preamble and macros, as part of your documents.
- You let us store, copy, process and send your content, including to the providers named in the privacy policy, only to provide notex to you. That means to convert your pages, store your projects and show them to you, and comply with the law. We use what you write in a problem report to look into it and to compare reports as we change the AI model or its instructions; a report does not give us your pages or the result. This permission ends when your content is deleted, except for the copies the privacy policy says remain for a time.
- We do not use your documents to train AI models.
- You are responsible for what you upload and type. Upload only pages that you have the right to upload and to have notex process, with any permission you need: for example, for notes or handouts that someone else wrote, or for other people’s personal information on your pages.
- notex is not a backup service. The pages you upload are kept only for a limited time: they are set to be deleted about 30 days after upload, unless you choose Keep where the app offers it, and storage removes them some time after that (privacy policy, section 4). We keep each project’s latest LaTeX and PDF until you convert the project again or replace its pages (either one replaces the current result, even if the new run fails; the app asks first), until you delete the project or your account, or until your account is closed or notex stops (section 10), but we can’t promise that nothing will be lost: files can be lost through an error, an outage or a provider’s failure. Deleting a project, its original pages or your account can’t be undone in the app, and we don’t promise to restore anything deleted. Keep your own copies of anything you need, for example by sharing the .tex file of each project.
8. AI results
- The AI can misread your notes: check the LaTeX and PDF before relying on them.
- Results can be wrong, incomplete or misleading. The model can misread handwriting, change a formula, leave out part of a page, or add something that is not in your notes. notex asks the model to print in red what it is not sure it read correctly, but text that isn’t red can be wrong too.
- notex transcribes your notes. It does not check that they are correct, and its results are not academic, professional or any other kind of advice. We don’t promise that a result is accurate, complete or fit for any purpose.
- Don’t rely on a result where a mistake could cause harm, for example in health, engineering, law or money matters, unless you have checked it against your own notes.
- You are responsible for how you use results. If you use them for a course or for work, follow the rules that apply there, such as your school’s rules on AI tools and academic integrity. Some ask you to say that you used AI.
- To tell us about a wrong or offensive result, open the project and tap Report a problem.
9. Acceptable use
Upload only content that is lawful and that you have the right to upload and to have notex process. Don’t:
- upload anything illegal, including material that sexually exploits children;
- upload content that infringes someone else’s rights, such as their copyright or privacy;
- try to break into, disrupt or overload notex, or get around its credits, limits, age check or security, for example by making extra accounts to collect more starter credits;
- copy, decompile or reverse-engineer the app or the service, except where the law allows it despite this rule;
- reach the service other than through the notex app (for example with scripts or bots), or resell or share access to it;
- use notex to build a competing service, or to collect results for training AI models;
- use notex to harm others or to break the law.
Because notex uses Anthropic’s model, you must also follow Anthropic’s Usage Policy when you use notex.
To report a problem with a result, use Report a problem on the project. To report anything else, write to support@notex.us.
If you live in Quebec, the next paragraph does not apply to you.
Claims caused by your content or misuse. To the extent the law where you live allows, if someone other than you makes a claim against us because content you uploaded infringed their rights or broke the law, or because you broke this section, you will cover our resulting losses and reasonable costs, including reasonable lawyers’ fees. This does not cover any part of a claim caused by our own fault. We will tell you about such a claim as soon as we reasonably can, and you may take part in answering it.
10. Suspending or closing accounts
- You can stop using notex at any time and delete your account (section 3).
- We may suspend or close your account, or refuse a conversion, if you break these terms or the law, if your use puts notex, its providers or other people at risk, or if the law requires it. Where we can, we tell you first and say why, by email to the address you sign in with. If you think we got it wrong, write to us.
- If we close your account, your credits end and we delete your data as the privacy policy describes for a deleted account.
- If we stop offering notex, we tell you at least 30 days ahead on notex.us, and in the app or by email, so you can save your .tex files (Share .tex on each project) or ask us for a copy of your data. If the law, a provider or a security problem forces us to stop sooner, we tell you as soon as we can. Then, once we have answered every request for access or a copy made before notex stopped, we delete accounts and their data as the privacy policy describes. Credits end, with no cash value.
11. Changes to notex
notex is new and will change. We may add, change or remove features, and change the limits, the AI model or the providers that run notex. We may also pause all or part of notex for a time, for example for maintenance or security, or while a provider is down. A change to how we handle your data also changes the privacy policy. We work to keep notex running, but we can’t promise it will always be available, fast or free of errors. Stopping notex for good follows section 10.
12. Our app and service
- notex, including the app, the service, the website and the notex name and logo, belongs to us or our licensors. We keep every right in them that these terms don’t give you.
- We give you a personal, non-exclusive, non-transferable license to install and use the notex app on devices you own or control, and to use notex under these terms. If you got the app from Apple’s App Store, your license to the app comes from Apple’s Standard EULA instead (section 20). The license ends when these terms end for you.
- The app includes open-source components under their own licenses, and these terms do not limit what those licenses allow you to do.
- If you send us ideas or feedback, we may use them freely, without owing you anything.
13. Your rights as a consumer, and our disclaimers
Nothing in these terms takes away a right that the law where you live does not let a contract take away. The disclaimers in this section, the limits in section 14 and the time limit in section 15 apply only as far as the law that applies to you allows.
If you live in Quebec: the disclaimers below and the limits in section 14 do not apply to you where the Consumer Protection Act or the Civil Code of Québec prohibits them. In particular, they do not limit our liability for our own acts or for bodily or moral injury.
To the extent the law allows, notex is provided free, “as is” and “as available”, and you use it at your own risk. Apart from what these terms and our privacy policy say, and any statement about notex that the law makes binding on us, we make no promises about notex. In particular, we don’t promise that results will be accurate, complete or fit for any purpose, that notex will meet your needs, that it will work without interruption, delay or errors, that errors will be corrected, that your content will be stored without loss, or that notex and your content will be safe from every unauthorized access. We disclaim all implied warranties and conditions, including those of merchantability, fitness for a particular purpose, title and non-infringement, and any that arise from a course of dealing or usage of trade.
14. Limits on our liability
If you live in Quebec: the limits below do not apply to you where the Consumer Protection Act or the Civil Code of Québec prohibits them (section 13).
To the extent the law allows:
- we are not liable for indirect, incidental, special, consequential, exemplary or punitive damages, or for lost profits, revenue, goodwill or data, lost or damaged content, or harm to your grades or studies, even if we were told they were possible;
- we are not liable for losses caused by relying on a result you did not check, by outages of services we don’t control (section 6), or by events beyond our reasonable control (section 19);
- our total liability to you for all claims about notex, taken together, is limited to US$50, or to what you paid us for notex in the 12 months before the claim arose, if that is more.
These limits apply whatever the claim is based on, including contract, negligence or another tort, or a statute. They do not apply to liability that the law does not allow to be limited, such as liability for death or personal injury caused by negligence, for fraud, or for harm we cause intentionally or recklessly (in Quebec, by intentional or gross fault).
15. Disputes
- Talk to us first. Most problems can be solved by writing to support@notex.us. We reply within 30 days.
- Notice before going to court. If you live in Quebec, this point does not apply to you: you can go to court at any time. Otherwise, before either of us starts a court case about notex (other than in a small-claims court), we each agree to write to the other first (you to support@notex.us, we to the email address you sign in with), say what the problem is and what would settle it, and allow 30 days to settle it.
- Time limit. If you live in Canada, Quebec included, this point does not apply to you. Otherwise, a claim by you or by us about notex must be brought within one year after the one bringing it knew, or should have known, the facts it rests on, or it can no longer be brought. The 30 days of the notice above don’t count toward that year. Where the law where you live sets a longer minimum for such a limit, that minimum applies instead; where it does not let a contract shorten the time at all, the law’s own period applies.
- Governing law. If you live in Quebec, the next sentence does not apply to you: the laws of Quebec and of Canada govern these terms. Otherwise, these terms are governed by the laws of the State of Wisconsin and applicable US federal law, without regard to conflict-of-laws rules. If you use notex as a consumer, you keep the protection of the mandatory laws of the province, state or country where you live.
- Courts. If you live in Canada, you can bring a claim in the courts of your province or territory, or in the state or federal courts located in Wisconsin. If you live anywhere else, a claim about notex goes to the state or federal courts located in Wisconsin, and you and we agree to their jurisdiction, unless the law where you live gives you the right to bring it in your own courts. Either of us can always use a small-claims court that has jurisdiction.
- No arbitration. These terms do not require arbitration.
16. Changes to these terms
- We may change these terms when notex, the law or our providers change. We may change these parts: credits, starter credits and limits (section 4); the price (section 5); the providers and the AI model (sections 6 and 11); how long we keep your content and what Keep does (section 7); features and how notex works (section 11); how accounts are opened, suspended and closed (sections 3 and 10); acceptable use (section 9); and any part that a change in the law requires us to change. If you live in Quebec, the next sentence does not apply to you: only the parts listed here can change this way, and any other change needs your consent. Outside Quebec, we may also change other parts of these terms in the same way.
- We post each new version on notex.us with a new effective date.
- For a change that reduces your rights or adds to your obligations, we tell you in the app and on notex.us at least 30 days before it applies. If you live in Quebec, we give you this notice for every change. The notice, or the page on notex.us that it links to, sets out the new or changed text, the text as it read before, the date the change applies, and your right to refuse it (below). When the privacy policy changes at the same time, one notice covers both.
- Other changes, such as corrections or new features, apply when posted, except in Quebec (above).
- If you don’t accept a change, you can stop using notex and delete your account, at no cost, before or after the change applies. If you keep using notex after a change applies, you accept it, except where the law requires your express consent.
17. Privacy
Our privacy policy explains what we collect, how we use it, who processes it for us, how long we keep it and your rights. It is a separate document, not part of these terms. Changes to it follow its own section 9.
18. Languages
These terms are offered in English and in French. Use whichever version you prefer.
19. General
- Transfer. We may transfer these terms, and notex with them, to a company we control (such as one formed to run notex) or to anyone who takes over notex. We tell you before the transfer, in the app or by email, and on notex.us. From the transfer on, that company or person is the party to these terms instead of Jacob Wadzinske and is responsible for notex; your rights under these terms stay the same, and the privacy policy continues to apply to data collected under it. If you don’t want to continue, you can delete your account (section 3). You may not transfer your account or these terms.
- If part can’t be enforced. If a court finds part of these terms unenforceable, that part applies as far as it can, and the rest still applies.
- No waiver. If we don’t enforce a term right away, we can still enforce it later.
- Events beyond our control. Section 14 limits our liability for a delay or failure caused by events beyond our reasonable control, such as an outage at a provider.
- What continues. If these terms end for you, for example when your account is deleted, the parts that by their nature should continue still apply, including sections 8, 13, 14, 15 and 19, the last paragraph of section 9 and the last point of section 12.
- Whole agreement. These terms are the whole agreement between you and us about notex, and replace anything earlier about it. This does not take away our privacy policy (section 17), which we follow, or any statement about notex that the law makes binding on us. If you got notex from the App Store, Apple’s Standard EULA also applies to the app (section 20).
- Contact. We may contact you at the email address of your sign-in, in the app or on notex.us. You can reach us at support@notex.us.
20. If you got notex from Apple’s App Store
If you downloaded notex from Apple’s App Store, Apple’s Licensed Application End User License Agreement (the “Standard EULA”) governs your license to the app, and these terms govern your account and the notex service. Where the two differ about the service, these terms apply. What notex collects and how it uses it are set out in our privacy policy (section 17), not in the Standard EULA’s section on data, and we follow the privacy policy.
